If you pay attention to South Florida politics, you're likely aware by now of the latest scandal involving Boynton Beach City Commissioner Marlene Ross. I say LATEST, because for many years, Ross has been engaging in illegal, unethical, and now immoral behavior during her tenure as a city commissioner.
This is NOT about racy photos or an incestuous relationship. This is about the rule of law, and a years long history of the city's other commissioners ignoring their own charter, and their own responsibly to do the right thing, and expel Ms. Ross. Here's why the Commission must act:
- Ross violated Florida's homestead law by taking a huge tax break on property she owns outside the city. For that, she should have been FIRED, as Boynton's charter states "The failure of a City Commissioner to continue to reside within the district from which elected, or the Mayor within the City, shall cause said City Commissioner or Mayor to automatically forfeit his/her office."
- Ross violated Florida election law by making false claims against her opponent in 2011. Breaking Florida election law is the very embodiment of improper conduct in office. In fact, the Charter gives the commissioners the power to expel a member for such conduct. For this offense, she should have been fired. From the Charter: "The City Commission shall be the judges of the qualifications, election and returns of its own members: it may enact rules of procedure and may prescribe penalties for the non-attendance or disorderly conduct of its members, and enforce the same. Four-fifths of its members concurring, it may expel a member for improper conduct in office."
- Ross reportedly maintained residency at Rennaissance Commons, even AFTER it was cut out of her district. This is a violation of the City Charter's residency requirements, and for that, ROSS SHOULD HAVE BEEN FIRED.
- Most recently, Ross violated common sense and nature's law by engaging in an inappropriate incestuous relationship with her first cousin, who also happens to be a convicted felon and a cocaine dealer. Is this not improper conduct? Perhaps not, in our post-Lewinsky political world. But what about signing a false statement? "Ms. Ross also admitted that she signed a false statement saying that Mr. Katz had not lobbied her." For this, ROSS SHOULD BE FIRED!
As you can see, this pattern of lawless, reckless behavior is not about sex. It's about the rule of law. Contact your Commissioner and mayor, and DEMAND they take action and FIRE Marlene Ross.
